These Terms & Conditions ("Terms") govern your access to and use of the LeadExploder website, applications, and services (the "Services"), operated by Mastodon Marketing ("LeadExploder," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
LeadExploder provides a marketing, communications, and customer-relationship platform for service businesses, which may include a Voice AI receptionist, missed-call text-back, automated follow-up, reviews, scheduling, and related tools. Features may change, improve, or be discontinued over time.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account.
3. Acceptable use
- Use the Services only for lawful purposes and in compliance with all applicable laws and regulations;
- Do not send unlawful, deceptive, harassing, or unsolicited messages, or otherwise violate anti-spam, telemarketing, or consumer-protection laws;
- Do not infringe others' rights, attempt to disrupt or reverse-engineer the Services, or misuse the platform.
4. Messaging compliance (your responsibility)
You are solely responsible for obtaining all legally required consents from the individuals you contact through the Services and for honoring opt-out requests, including under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and carrier/A2P 10DLC requirements. You agree to indemnify LeadExploder for claims arising from messages you send.
5. Fees, billing & cancellation
- Paid plans are billed in advance on a monthly or annual basis at the rates presented at sign-up;
- Subscriptions renew automatically until cancelled; you may cancel at any time, effective at the end of the current billing period;
- Usage-based charges (such as telephony, SMS, or AI usage) may apply and be billed in addition to subscription fees;
- 30-day money-back guarantee: if you are not satisfied, contact us within 30 days of your initial paid subscription for a refund of that initial subscription fee, as described at the point of sale.
6. Intellectual property
The Services, including software, content, and trademarks, are owned by LeadExploder or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of your own content and Customer Data.
7. Third-party services
The Services may integrate with or rely on third-party providers. Your use of those services is subject to their terms, and we are not responsible for them.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee any specific results, revenue, lead volume, or income. Any figures, savings comparisons, or ROI estimates presented on our website or in the Services are illustrative only and are not a promise of results; actual outcomes vary by business.
9. Limitation of liability
To the maximum extent permitted by law, LeadExploder will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the amounts you paid us in the three (3) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless LeadExploder and its affiliates from claims, damages, and expenses arising from your use of the Services, your content, your messaging activity, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate access if you violate these Terms or for risk, legal, or operational reasons. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Harris County, Texas, unless otherwise required by law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.
